YOU SAID:

This Service Order/MACD is entered into in the context of the declared Covid-19 pandemic (the “Pandemic”). At the moment of entering into this Service Order/MACD, to the best of its knowledge and based on currently widely known public information, Bell does not reasonably anticipate that it will not be able and expects to perform its obligations in accordance with this Service Order/MACD and the Master Agreement and/or service schedule (the “Agreement”) governing the Service Order/MACD and will use commercially reasonable efforts to do so. However, as circumstances continue to evolve, Customer acknowledges that Bell may at some point be unable to perform or become prevented from performing said obligations (either fully or in part) due to a situation arising out of or occurring in the context of the Pandemic. Therefore, for further clarity, the mere fact that the Pandemic is already in existence and that measures have already been implemented by the public authorities at the time of entering this Service Order/MACD will not, in and of itself, automatically make further consequences of the Pandemic “foreseeable events”. As such, Bell reserves the right, subject to the Agreement and applicable law, to claim that a force majeure event has occurred in the future, even if said event arises out of or occurs in the context of the Pandemic.
